Chapter 14
It was just a hearing with the judge to determine what came next with Martin's deceased husband's request he become a woman legally and physically. It was the law that was in question and how to implement such a law.
If the Baron had survived, Martin would have already begun the process of a sex change and legal change of his gender status. The Baron had made his intentions clear with his mother and authorized her and his lawyer to act on his behalf while he was to be away. Then he suddenly died, but should his desires for his wife, that under law he had every right to make, be honored even in death. That is what they were here to decide.
Martin's attorney, Sarah didn't think so, and she was trying to get the case dismissed.
The day of the hearing had arrived
and Martin was in the back seat of the car being driven to the courthouse. He
had been coached on his responses as he didn't want it to appear that he didn't
care about the Baron and his wishes after it had been argued on his behalf how
much he loved him to the finances settled. Sarah had told him to just suck it up
and tell them what they need to hear and get this done.
Martin was today dressed in a
manner not of his own choosing. It was definitely not appropriate for a legal
proceeding. He should have been wearing matching pant suit and blazer, but he
was wearing a knee length emerald cocktail dress with a sequined bodice. His
D-cup bullet bra was padded and had no sag to the look. It was as if his breast
were pushing straight out and pointing slightly to the sides. He wore a pair
of matching emerald 4" spike heels. His pink hair swept up in a French Twist. He
wore long rhinestone earrings and his PPP collar was around his neck, pulled
tight and clamped.
Martin was seated up front and
the bailiff shackled one of his ankles to the chair. The nature of this
proceeding made it possible that he might try to leave his seat and this was
just a precaution.
The judge entered the room. Judge
Harper was an attractive young woman in her mid thirties, and she asked all to
be seated while she looked over the files.
"We are here today to decide on
how to proceed with Baron Vargos's request before he died, that his male
husband, Marcia Vargos, under go a sex change process that would included RSR
and document changes that would change his gender to female all the way back to
birth. Is this correct?" she asked looking up at both sides.
"Yes your honor," the Baron's
attorney said.
"Yes your honor ," Sarah said
glancing over at Martin.
She had hoped that after all
the time she spent talking with him that he would not make a scene in the
courtroom. She didn't want to see him muzzled again.
"So, let me start with you,"
the judge said looking to Sarah. "What is you opinion on
this?"
"Your honor, Marcia Vargos
loved his husband very much and even dressed and lived as a woman for the Baron
because he so desired it. Marcia is at a great emotional loss right now. He has
suddenly lost the his husband, has been awarded his estate, and would like to be
able to dress as a woman or not dress as a woman based on his own desires. He is
also requesting that the court understand that when he would dress as a woman
now, it would be for the memory of his husband. He has no desire to be a woman
in the full legal sense. We feel that the SRS request was leveraged of the Baron
by his mother. We feel the Baron really didn't know what was being asked at the
time."
"I see." said the judge. She
looked at Martin and the way he was dressed. "Do you agree with that
assessment?" she asked.
"Yes, " Martin said
softly.
"And what of your arguments,"
the judge now looked over to the other side. Constance was seated at the table
with the attorney's.
"Your honor, we feel that the
Baron's wishes should be recognized and fulfilled. Marcia Vargos is not the
loving spouse you have read about and heard testified this morning. He was
placed in an arranged marriage by his family with the Baron. The Baron loved and
lavished this young man with everything a wife could want. He was taken care of,
and as they defense has so testified, he enjoyed dressing as a woman for his
husband."
Martin looked straight ahead
with jaw clenched tightly together.
"And after all this, Marcia
Vargos committed adultery while the Baron was away. This is after doing the
traditional Three Nights of Consummation and Vow of Chastity. He did this
knowingly and while dressed fully as a woman. I bring that up because it seems
to me that he was living every aspect of his life as a woman and he had like it.
Once he committed adultery and his husband decided that his penis and testicles
should be removed, and his gender changed in the records he all of a sudden
wants to be a man now? Something is wrong
either with the first part of their story or the second. The bottom line is the
Baron had every legal right to make this request for his wife, and that request
should be followed through with."
"This is a very difficult
case. We do have the husband's lawful rights to have sexual reassignment surgery
performed on his male wife in this type of marriage scenario. We also must be
mindful, that although Ms. Vargos has no legal standing this procedure based on
that law, we must consider his welfare after the fact now that the Baron is no
longer here to see after him. Will having his gender reassigned alter his
ability in business, community, and social standing in such a way that would
keep him from an otherwise active and productive lifestyle.
She looked at
Martin.
"Ms. Vargos would you please
stand," she said looking at him in more detail now. "As a matter of law your
husband had every right to request your gender be changed. It is also clear that
there is representation for your husband to see that this request is done. I
have some concerns about just ordering you to have this proceed. Without
more opinions on the social, psychological, and future prognosis on how you
would fair as a woman after living 29 years from birth as a man. I will order a
team of experts to examine you and cons el with you to determine if we should
proceed and if the process should be moved forward and whether you should be
placed into custody and kept at a psychological facility until the process is
complete."
Martin the said, "Ma'am. I
don't want to be a woman. I want to remain a man. I dressed like this for my
husband and now he's gone. This is crazy and makes no sense at all. I have the
rights to my own self determination now."
"But you didn't when your
husband decided you should be female instead of male." the judge
said.
"I want nothing to do with
this," Martin snapped.
"Mrs. Vargos what you want is
not the question here. We are here to determine if your late husband's
wishes should proceed or not. I have asked for professionals in different fields
to examine this question and report their findings based on expert opinions that
will be given to me. I will then make a decision with the support of that
information. That is how it will be done."
"But I........." Martin was
cut off.
"Because I feel you are a
flight risk, I am also requiring you to wear a monitoring device during this
period. You are being placed into custody immediately. Please follow the bailiff
down the hall to have it put in place and calibrated. You will then be released
to a court appointed custodian. The restrictions of your movement will be
explained to you. Court is adjourned."
Martin just stared at her
for a moment. Then lowered his eyelids, and then his head.
"Why are they obsessed with
being a woman here?" he thought. "I see what appears to be normal men
everywhere, why am I kept captive, feminized, and humiliated and nobody even
offers any words of concern for my situation."
"You are going to get yours,"
Constance laughed walking by. "I want my money and just maybe I'll see if I
can call off the hounds."
Martin was led down the hall
to a small office where a woman was doing some paperwork. She finished what she
was doing and looked at Martin.
"My we are dressed in a
provocative manner aren't we, " she said standing. "Have a seat right here
please," she said motioning to a wooden chair in front of her desk.
She picked up the leather collar
that was on her desk. It was very similar to the one he had worn when he had
attempted to escape from before. It was not as ornate or decorative as the other
one as it was built strictly for function, as the one he had before was
decorated to to try and blend in as a fashion piece.
"Lift your chin up please, " she
said in a firm voice.
She put the collar around
Martin's neck from behind. He felt her snug it up to his throat and then it was
tightened. The strap had 6 round metal disc embedded in it. These were to
deliver shocks in case it was activated to the neck area. It needed to be fitted
very tightly, almost too tight.
Wires from the disc hung ay
the back of his neck. The next part of the collar was then placed over the disc
strap. It was much bigger and very cumbersome. It was not going to be possible
to disguise the fact he was wearing this. It was designed for function and as
part of a law enforcement program for home arrest. Many citizens have to wear
these as part of their sentence or as apart of a bail agreement, but most stay
home and don't risk going out in public and being seen wearing these
contraptions.
Martin looked at the black
leather device. It looked too large to wear. The woman had Martin lean his head
back so she could slip the collar under his chin. It had a slight bevel at the
top so his jaw could sit inside it comfortably at least as could be expected.
She pulled the collar around his neck and then buckled the three leather straps
holding it tightly in place. Martin's head was now held firmly in a tilted
position. His chin raised slightly and head back. It would take some getting
used to to see where he was walking. A metal clamp closed over the buckles and
was locked so the collar could not be removed.
A large battery pack was
attached to the back of the collar and the wires to the shock disc hooked to it.
It was big and bulky. It was a full 2" high and 4" long and and stuck out almost
2".
"Court Ordered Law Enforcement
Device. Do not assist in removal under penalty of law." was on the battery case
in bold red letters. She hooked the wires from the large collar not to the
battery. These wires went to the Strobe Flashers and the six little alarm
speakers that gave a constant piercing high pitched alarm once it was activated
and remained till it was turned off. Three of the lights now flashed slowly and
randomly.
She then placed another label on
the front of the collar.
"Registered Crossdresser," it said
in bold letters.
"Alright Ms. Vargos. You have been
ordered to wear a Level 1 House Arrest device by the court. I have placed this
collar on you now, and it has been calibrated. You are under a Restricted
Movement Order and the device will activate if you leave the designated area for
any length of time. The device can only be turned off by a law enforcement
official. Do you understand?"
"Yes," Martin said staring
straight ahead.
"You may not go in public alone.
You must be accompanied by a court appointed family member, who will be
responsible for your public actions."
"I am not a criminal. Why am
I being treat like this?"
"No you're not, but you have
been deemed a flight risk," she said signing the last of his
documents.
"For not wanting to be castrated
and turned into a woman? How can you do this to me? A group of people are right
now sitting around discussing whether my dick and balls should be cut off, and I
am forced to wait on their verdict while being treated like a
criminal?"
"Sir, I only deal with the
Restriction Orders. I have men and women in here everyday crying and blubbering
like children that they shouldn't have to wear a House Arrest Collar and how
embarrassed they will be when family and friends see them but they should have
thought of that before they did whatever it was to get the collar placed around
their neck in the first place. I just enforce the court ordered warrant. I don't
create the warrant. Take it up with your lawyer," she said helping him up from
the chair.

Martin was escorted by an officer
down the hall. Sasha was sitting outside the restricted area and saw him in the
collar.
"Oh my god," she said to
herself.
Martin was led into an office and
sat down in a large comfortable chair. One of his ankles were shackled to the
chair leg. A pleasnat looking woman came in with a folder and had a seat at the
desk.
"Ms. Vargos, my name is Linda Carver.
I am a counselor for male to female transgender candidates. There are quite a
few of these surgeries done in this country as we have a great facilities and
doctors in this field. I have been asked to interview you and access your mental
well being on the prospect of becoming a woman."
"I don't want to be a woman damn it.
Why can't you all get that through your head? No need to talk. The answer is
no."
"Why not Ms. Vargos. You have lived
as a woman for quite a while now, whay do you have against becoming a woman
legally."
"I have been forced to live as a
woman. I don't desire to wear dresses. I was forced to be married to a man that
used me for his sex slave."
"I understand that you may have
been in a unwanted marriage, that often happens in arranged marriages, but I
want to know is what you have against actually being a woman?"
"What? I am a man. I want to stay a
man. I want to keep my male identity. What kind of question is
that?"
"You look very nice dressed as a
woman Ms.Vargos so socially you would blend in fairly well. If your sex were to
be changed to female what do you feel would be your biggest obstacle would be in
accepting and being a woman?"
"WHAT!!!"
"You are financially well off,
you have an established reputation of moving in public as a woman already, and
you were married to a man and lived with him as his wife, so with all that, what
would be the negative effect in your mind of actually becoming a
woman?"
"Why would I as a man want to
be a woman. I am a straight man, I am not attracted to men at all. I feel
totally humiliated dressed as I am dressed now. I want to have a normal life as
a man with a girlfriend and as far from here as I can get."
"I see," she said making some
notes. "Ms. Vargos you do understand that in this country we believe that male
and female genders are completely equal, so why do you feel so humiliated when
people see you dressed as a woman or having a husband. It is not something that
belittles you as a male. Being female or looking like a female is not something
to be ashamed of."
"I AM NOT GAY! I AM NOT A
TRANSVESTITE!"
"I understand, yet when you
were placed into the marriage with your late husband you seemed to have adapted
very well, as a male bride. All I am saying is little would change except you
would have a surgically constructed vagina and breast, and you could choose to
be with a woman if you so choose as it would be a legal same sex
marriage."
"Are you insane? I'm not
doing it lady."
She gathered her paperwork
and prepared to leave.
"So far you have given me no
good reasons why you should not be a woman. As a woman you would not be deprived
of anything you have now, nor in my opinion would you suffer any undue public
harassment or additional humiliation based on your present lifestyle. Being a
woman is not a punishment Ms. Vargos and it will change your present lifestyle
in a very minimum manner."
"You think so!" Martin
snapped at her. "You are an insane bitch. You have no qualms with having a man
castrated for no crime, completely against his will, just so you can say I am a
woman."
"It's called SRS sir, and
I have no qualms at all suggesting a man be a woman if I feel after a
careful diagnosis that is what he should be. Many men that should be women are
in denial because they fear what others will say when they are brought
out."
"You have forced men to
become women that didn't want to be women because you felt they were in denial?
Who do you think you are?"
"It is not quite that
simple. We have done much research and have a 98% effective
rate."
"And the final two percent
just have to figure out how to go on as women."
"It seldom happens that we
misdiagnose."
"And what have you decided
for me in 15 minutes of diagnosis."
"We'll see. I can't
discuss this outside the judges
chambers."
